Daddy Dearest trial-March 20th

Steven Powell’s trial on voyeurism and porn charges is due to go ahead on March 20th but will the old creep’s defense lawyers get him off? Powell has been incarcerated in the Pierce County, Wash., Jail since Sept/11.

The defense is claiming that the search warrant on Powell’s Puyallup home was illegal.

According to a motion filed to have the images suppressed, Steven Powell’s attorneys contend that the images seized violated their client’s Fourth Amendment rights. The affidavit that was used as the basis for the search warrant “failed to establish probable cause,” according to court documents.

Prosecutors intend to fight his suppression motion and are confident the evidence will remain admissible, Pierce County Prosecutor Mark Lindquist said this afternoon.

“This is a case where law enforcement was especially meticulous,” Lindquist said. “They did things by the book.”

    Oh PS! I don’t think Powell has a leg to stand on. I believe with all my heart this man is going away for a very long time. I pray those images of those little boys burning stays in his mind every time he lays down and tries to sleep. But I doubt it.

    Thank you for the update. His lawyers are just doing the regular schtick they’re obliged to perform and I fear not the judge will just as predictably toss this motion out, like the stage manager with his long hook in those old cartoons. The pressure is on for the perv, though. Let’s see what gets worked out….

    Since Susan Powell has not been found or declared dead, Susan was still married to Josh and Susan’s parents had a legal trust set up wouldn’t Susan parents be in the legal position to collect all monies from Josh’s death for the trust? I don’t know just asking.

    I was just trying to figure out Josh Powell’s life insurance policy. I see another court case over who is entitled to be the beneficiary. Josh left the biggest share to his brother, Michael. We seldom hear much about Michael. I also googled the following… *

    Your beneficiary can collect benefits from your insurance policy if you commit suicide if,

    1. *Your policy provisions for payout in the event of suicide.

    cali patti~ ~I am wondering how many years have to pass before a missing person can be declared dead and the beneficiaries able to collect. Josh changed his policy and took Susan off as beneficiary around Oct or Nov/11. The question is, was Josh within his legal rights to amend the policy??

    A life insurance company has asked a judge to decide whether any of Josh Powell’s relatives are entitled to collect on a $1.5 million policy after he killed himself and his two sons in a Washington house fire last month.

    In a complaint filed in U.S. District Court in Tacoma, New York Life said that on Feb. 14, nine days after the deaths, it received inquiries from Powell’s sister Alina and brother Michael about how to make claims on the policy, which included $1 million for Josh Powell and $250,000 for each boy. The company sent them claim forms, but the siblings have not actually filed them.

    The company asked to turn over to the court’s control the proceeds payable under Josh Powell’s five-year term policy, as well as a $1 million policy covering his wife, Susan Powell, who disappeared from their Utah home in 2009 and is presumed dead. The judge would decide who, if anyone, gets the money from each policy — saving the company from being sued over any decisions it might otherwise make.

    “The pending and potential claims are such that New York Life cannot determine without hazard to itself which of them, if any, is legally entitled to the policy proceeds without assuming the responsibility of determining doubtful questions of law and fact,” the company’s attorneys wrote in a complaint filed last Friday.

    Josh Powell made several changes to his policy in the months before his death — making the beneficiaries his siblings and father rather than his missing wife. Among the company’s questions is whether those changes are valid. Susan Powell may have had a community-property interest in the policy, so it’s not clear that her husband could cancel her as the beneficiary without her consent, the lawyers wrote.

    Furthermore, given his suicide, it’s not clear that Powell was legally competent to make those changes when he did so last October and December, the company’s lawyers wrote.

  11. Steven Powell appeared briefly in Pierce Co. Superior Court on Friday, where a judge scheduled an April 23 hearing on a motion to suppress evidence in the criminal case against him. The judge also scheduled a May 7 trial.

    What is up with all the postponements????//// ykw, jodi and now pervert. Another beautiful 23 year old woman with a 10 month old baby was found first of week , shot three times, in her car. Practically in my back yard, Tallahassee, Fl… LE said she put up a sruggle so the dna was plentiful. They already have the monster. It was of course drug related, when will these people learn, If the drugs don’t get you the dealers will. Now there is yet another 10 month old child without a mother. I say send them all to Texas.
